Terms of service

These terms are an agreement between you and graspy ("we", see company details) about using graspy at graspy.app. By creating an account you accept them.

1. What graspy is

graspy is a workspace for people who buy and sell services on the SWAPD marketplace: a ticket list, templates, a checkout composer, listing tools, market statistics and money overviews. graspy is a separate product from SWAPD. It never posts, sends or changes anything on SWAPD: you copy text from graspy and paste it on SWAPD yourself. You stay responsible for what you do on SWAPD and for following SWAPD's rules, including keeping payments inside SWAPD's escrow.

graspy is software only. We do not provide, sell, broker or guarantee any of the services that members buy or sell on SWAPD, we are not a party to any deal, and we never hold or move money for a deal. Category names in graspy, such as "Username claim" or "Deindex / takedown", describe how members label their own work and are not an offer by us.

2. Your account

• You must be 18 or older and use your own email address. One person per account; do not share it.
• During early access we review sign-ups by hand and may decline or end access.
• Keep access to your email secure: anyone who can read it can sign in.

3. Price

graspy is free during early access. Before paid plans start we tell you the price and the date by email at least 14 days in advance. Nothing is charged unless you choose a plan.

Access runs for a period, which you see in Settings. When we give you free days, they end on the date shown and nothing is charged afterwards. When your access ends you can still sign in to download or delete your data.

4. Acceptable use

If you sell services, you alone are responsible for making sure each service you offer and deliver is lawful where you and your buyer are, respects the rights of others, and follows the rules of every platform involved. Only offer work on accounts, names or content that the buyer owns or is authorised to act for. graspy does not check or approve the services you offer.

You may not use graspy for anything illegal, for fraud, or to arrange deals outside SWAPD's escrow. You may not scrape graspy, access it with bots or scripts, overload it, try to get around its security, or access other people's data. Security research is welcome only under our disclosure policy.

5. Our software

graspy's software, design, texts and name belong to us. You get a personal, non-transferable, revocable right to use graspy through graspy.app while your account is active. You may not copy, extract, decompile, reverse engineer, rebuild, resell or offer the software or its code, in whole or in part, except where the law allows this despite this clause.

6. Your data

What you put in your workspace stays yours. You give us permission to store and process it only to provide graspy to you. You are responsible for having a lawful basis for any personal data about others that you store. For business use our data processing terms apply. How we handle personal data is in the Privacy policy.

7. Market statistics

Prices and Find a seller are indications based on past deals. They are not advice or a promise of any result, and they can be incomplete or out of date.

8. Availability

We work to keep graspy available and safe but cannot promise it is always available or error free. We may change or stop features; if we stop graspy altogether we give you at least 30 days to download your data.

9. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, including lost deals, lost profit or loss caused by third-party platforms. Our total liability is limited to what you paid us in the 12 months before the claim, or €100 if you paid nothing. This does not limit liability for intent or gross negligence, or rights that consumers cannot give up.

10. Ending

You can delete your account any time in Settings; your workspace is deleted with it. We may suspend or end an account that breaks these terms, and where reasonable we tell you why.

11. Changes

If we change these terms in a way that matters, we email you at least 30 days before. If you do not agree you can delete your account before the change takes effect.

12. Law

Dutch law applies. Disputes go to the competent court in the Netherlands. If you are a consumer, you keep the protection of the mandatory law of the country where you live and can also go to your local court.
